These Terms of Service ("Terms") govern your use of the Brokerworks Group website and the BrokerWORKS platform (together, the "Services"), operated by Brokerworks Group ("we," "us," or "our"). They apply to consumers (home buyers, sellers, and website visitors) and to real estate agents and staff who use the BrokerWORKS platform. By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility & Accounts

You must be at least 18 years old to use the Services. If you create an account — as a consumer using our client portal or as an agent using the platform — you agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. We may suspend or terminate accounts that violate these Terms.

2. Consumer Use of the Services

Our website provides property listings, home search tools, valuations, market reports, and ways to contact our agents. This content is for your personal, non-commercial use in evaluating real estate. Submitting a form, saving a search, or using our home-finding tools does not create an agency relationship with Brokerworks Group; an agency relationship is formed only through a separate written agreement as required by Indiana law.

3. Listing Data & Accuracy

Listing information is provided by the Multiple Listing Service (MLS) and other third parties and is deemed reliable but not guaranteed. Property details, availability, pricing, estimated values, school and district information, and market statistics may be inaccurate, incomplete, or out of date, and are provided for informational purposes only — they are not a substitute for professional advice, an appraisal, or an inspection. Verify all information independently before making real estate decisions.

4. Agent & Staff Use of the Platform

Agents and staff are granted a limited, non-transferable license to use the BrokerWORKS platform for legitimate brokerage business. You agree to: (a) use client information only to serve those clients and in compliance with applicable law, MLS rules, REALTOR® Code of Ethics, and brokerage policies; (b) not scrape, resell, or export platform or MLS data for use outside the brokerage; (c) maintain the confidentiality of consumer information; and (d) comply with all licensing requirements. Your access ends when your affiliation with Brokerworks Group ends. Business records created in the platform related to brokerage transactions remain records of the brokerage as required by law.

5. AI-Assisted Features

The platform includes AI-assisted features (such as our assistant "Andy") that can draft emails, summarize information, prepare market analyses, and automate tasks. AI output may contain errors. Agents are responsible for reviewing all AI-generated content before relying on it or sending it to any client or third party. AI-generated valuations and analyses are opinions of value for discussion purposes and are not appraisals.

6. Acceptable Use

• Do not use the Services for any unlawful, fraudulent, or discriminatory purpose, including violations of fair housing laws;
• Do not attempt to gain unauthorized access to any part of the Services or another user's data;
• Do not interfere with the operation of the Services, introduce malware, or place undue load on our systems;
• Do not impersonate any person or misrepresent your affiliation;
• Do not use automated means to collect data from the Services without our written consent.

7. Communications

By providing your contact information, you consent to being contacted by Brokerworks Group and its agents by email, phone, or text about your inquiry and related services. Message and data rates may apply. You can opt out of marketing emails using the unsubscribe link in any message and out of texts by replying STOP.

8. Intellectual Property

The Services, including our branding, design, software, and original content, are owned by Brokerworks Group or its licensors and protected by intellectual-property laws. MLS data is owned by its respective providers. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted.

9. Third-Party Services & Links

The Services may link to or integrate with third-party services (such as Google, mapping providers, and transaction-management systems). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BROKERWORKS GROUP AND ITS AGENTS, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, or obligations arising under a separate written brokerage agreement.

12. Indemnification

You agree to indemnify and hold harmless Brokerworks Group from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or applicable law. You may stop using the Services at any time. Sections that by their nature should survive termination (including Sections 3, 8, and 10–12) will survive.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Indiana, and you consent to their jurisdiction. Nothing here alters dispute provisions in a separate written agreement between you and Brokerworks Group.

15. Changes & Contact

We may update these Terms from time to time; the effective date above reflects the latest revision, and continued use of the Services after changes are posted constitutes acceptance.
